Terms of Service

These terms govern your use of the Swaypi creator-data API and website ("Swaypi"), operated by Willhite Strategy Group ("we", "us"). By creating an account or using Swaypi, you agree to these terms. If you are using Swaypi for an organization, you agree on its behalf.
1. The service
Swaypi provides a REST API returning information about creators, compiled from publicly available sources, along with the accounts and documentation needed to use it. Swaypi is currently offered in private beta; features, limits, and pricing may change as the service develops.
2. Your account
- You must provide accurate account information and keep it current.
- You are responsible for all activity under your account and your API key. Keep your API key secret — treat it like a password. Anyone holding it can use your subscription.
- Notify us at hello@swaypi.com if you believe your key has been exposed, and we can help rotate it.
- You must be able to form a binding contract to use Swaypi.
3. Acceptable use
You agree to use Swaypi lawfully and not to:
- exceed, evade, or interfere with rate limits, quotas, or authentication;
- attempt to disrupt, overload, probe, or gain unauthorized access to the service or its infrastructure;
- use the data for unlawful, deceptive, harassing, or discriminatory purposes, or in violation of any third party's rights or of applicable data-protection and anti-spam laws;
- resell, redistribute, or publish the raw Swaypi dataset as a standalone competing data product;
- misrepresent your identity or share a single account's credentials to circumvent plan limits.
You are responsible for how you use data obtained through Swaypi, including any outreach you conduct with it.
4. Rate limits and fair use
Each plan carries a request quota and rate limit, described in our documentation. We may apply reasonable technical limits to protect the service and may throttle or temporarily restrict usage that threatens its stability or that materially exceeds fair use for your plan.
5. Plans and billing
Paid subscriptions are billed through Stripe, our payment processor. By subscribing to a paid plan you authorize us, via Stripe, to charge the applicable fees for your billing period. Fees are billed in advance and, except where required by law, are non-refundable. Your card details are handled by Stripe under Stripe's Privacy Policy; we do not store your card number. While Swaypi is in free private beta, no fees apply until paid plans are introduced, at which point continued use of a paid tier is subject to the then-current pricing.
6. Intellectual property
Swaypi, including its software, documentation, branding, and the compiled dataset, remains our property. Subject to these terms and your plan, we grant you a limited, non-exclusive, non-transferable right to access the API and use the data it returns within your own products and workflows. You retain ownership of your own applications and content.
7. Data accuracy and no warranty
Swaypi is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Creator data is derived from public sources and is provided for informational purposes; while we work to keep it fresh and accurate, we do not warrant that it is complete, error-free, or continuously available, and we do not guarantee any particular uptime during the private beta.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of or related to your use of Swaypi. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us for Swaypi in the three months before the claim, or, where you paid nothing, US $100.
9. Suspension and termination
You may stop using Swaypi and close your account at any time. We may suspend or terminate access if you breach these terms, if your use poses a risk to the service or others, or if required by law. We may also discontinue the service or any feature; where practical we will give reasonable notice. On termination, your right to access the API ends.
10. Changes to these terms
We may update these terms as the service evolves. When we make a material change we will revise the effective date above and, where appropriate, notify you. Continued use of Swaypi after a change means you accept the updated terms.
11. Governing law
Placeholder — to be confirmed by Swaypi. These terms are governed by the laws of the jurisdiction in which Swaypi's operator is established, without regard to conflict- of-law rules, and any disputes will be handled in the courts of that jurisdiction. The specific governing state and venue will be inserted here once confirmed.
